Mini Session Terms and Conditions

1. Package Fee

The Package fee covers a 20 Minute Mini Photo Session, editing and 2 digital photos or 30 minutes and 5 digital photos depending on whether you have booked an autumn or Christmas mini session. The package fee is payable at the time of booking to secure your chosen session time on the date specified on the booking form & is non refundable, except in the case where Katy Howe Photography may cancel a session. 

2. Rescheduling/Cancelling

Photographer may reschedule the session due to Photographer’s illness or unforseen circumstances and will work with Client’s schedule to reschedule as soon as possible. If Client needs to reschedule due to illness of key person’s involved in the session, Client will do his/her best to notify Photographer at least 24 hours prior to the session, or at least as soon as possible after the issue is identified. The non-refundable fee can be transferred to another day and time upon the rescheduling of a session, so long as the rescheduled session takes place within 2 weeks of the original session date, otherwise the fee will be forfeited. If the Client cancels a session for any reason, the Client will forfeit the fee. 

3. Prices and Products

The package fee does include: a 30 Minute Mini Photo Session, editing and 5 digital images of the client’s choosing, but does not include any further prints or products. Any additional prints or products can be purchased separately at the prices shown in my current price list. A full price list is available to all clients upon request and it is presumed that every client in receipt of the price list will have read the information fully.

4. Fulfilment of Obligations

Katy Howe Photography shall not be liable to the client for any failure, in whole or in part, to fulfil it’s obligations where failure arises as a result of an event or circumstances beyond it’s control, which may include (but not limited to)  equipment failure, inclement weather, illness, injury or Government Announcements. The Client understands and accepts that the photographic coverage will be as Katy Howe Photography’s professional expertise determines. Special requests are not binding instructions although every effort is made to accommodate the clients wishes. In the event of weather deemed unsuitable by Katy Howe Photography, the session will be rescheduled at the earliest convenience for both parties. In the unlikely event of total photographic failure or cancellation of the contract by Katy Howe Photography liability shall be limited to a full refund of all monies paid.

5. Late Arrivals

All Clients are required to arrive on time for their session, in order to ensure Katy Howe Photography can run the mini sessions according to the advertised schedule. Late arrivals will have their session cut in accordance with how many minutes late they are, in order to preserve the start time of the next session. E.g. Clients who are 10 minutes late will receive a 10 minute mini session. If you miss your time slot entirely you will be required to wait until the last session is finished. Refunds are not permitted for lateness. Refunds for missed sessions will be considered for exceptional circumstances only.

6. Proofs & Ordering

There is no guarantee that any set number of proofs will be produced. Proofs will be available to view in a private online viewing gallery within 2 weeks after your session has taken place.  The gallery will remain live for 14 days and will then expire. All orders should be placed within the 14 day period that the gallery is live. For all orders, payment is due in full at the time of order. All print orders are final once placed and cannot be changed or refunded for any reason.

7. Artistic Input

Katy Howe Photography shall be entitled to use it’s judgement regarding the style and artistic input in the production of photographs. This includes but is not limited to poses, props and number of images taken. Where children are involved in a session, it may not be possible to capture all the poses requested, or images to the clients full expectations. In the event of uncooperative children at a session, for any reason, Katy Howe Photography may not be able to capture any, or as many images as the both parties may have expected. The client is responsible for all children at all sessions. Images are fully edited before presenting to client.

8. Copyright and Reproduction

Copyright is owned by Katy Howe Photography and is retained at all times worldwide. No image can be reproduced in any form whatsoever without the prior consent of Katy Howe Photography. The Client may not alter, add to or manipulate a photograph by any means or reproduce a photograph in whole or in part as an element within, or as a montage, with, another image without Katy Howe Photography’s written permission. Permission to reproduce a photograph for personal use (not commercial) is granted to the Client by Katy Howe Photography only when digital files are purchased and paid in full by the Client to Katy Howe Photography. A Print Licence will be issued to the Client at time of purchasing the digital files from Katy Howe Photography.

9. Use of Photographs

Katy Howe Photography retains the right in all cases to use any photographs for the purposes of displays, advertising, portfolio, publication or promotion of it’s work. You have the right to opt out by expressing your wishes in writing to Katy Howe Photography.

10. Receipt of Goods

All  orders are presumed to have been received in good condition unless the Client notifies Katy Howe Photography in writing of any discrepancy or error within 24 hours of receipt.

11. Cooling Off

All printed products, including but not limited to, prints, frames, canvases, other wall art are non refundable. Orders cannot be cancelled due to the custom nature of the products. Orders are made to the Client’s personal specification. The Client does not have the right to a cooling off period. When placing an order with Katy Howe Photography you are committing to buy the ordered products. Printed products will not be ordered until payment is received in full. 

12. Returns Policy

Incorrectly supplied items and items of poor quality may be returned and will be replaced at no extra cost to the Client. Returns will not be considered for items ordered by the Client in error.

13. Expired Galleries

All images in your online gallery may be deleted or archived 30 days after your viewing gallery has expired.

14. Client Cameras

Clients are not permitted to use their own cameras, mobile phone cameras or camcorders during any photography session with Katy Howe Photography.
